Minimum age:
Minimum
age: 21-23-25 -30 years as per type and model of vehicle.
Driving license:
full current driving license valid since
one year for cat. City Car, and 2 years for the other categories.
Same conditions for additional driver approved by Elite at the
time of the rental.
- Each
driver must hold a driving licence (current driving licence
B Category) valid for the country where the
rented car will be used; the driving licence must have been issued
for a
minimum period established by law or by local regulations in
order to drive the rented car; driving licences that are
printed in non latin characters must be accompanied by an
international driving licence.
- The
minimum requested age for a car rental is established in the
current price list and it can be 21/23/25/30
years according to the rented car category. Whenever the person
who rents the car and/or the driver is
younger than the age requested by ELITE regulations for the
category, he is aware that the car rental
can be denied or that ELITE RENT A CAR ITALIA will apply a
different and higher value to the liability
coverage as established in following Sect. 2.1
Additional driver:
Euro 5 per day.
Minimal rental duration:
one day = 24 hours. After 3 extra
hours, a full day will be charged.

Fuel & Maintenace:
Current prices do not include fuel. Rented vehicles are normally
supplied with full fuel. The amount of missing fuel
when the vehicle is returned will be charged to the Customer
(€ 2,75/lt
including the refuel service).
Current prices include ordinary maintenance, oil and fuel. Possible
costs due to emergency intervention, expressly
approved by ELITE RENT A CAR ITALIA and only if the intervention
request can be demonstrated at the phone
numbers indicated on the Agreement, will be refunded against submission
of the original invoice.
Payment conditions:
One or two credit cards authorised
by Elite, as per vehicle model. Insurances:
The Third-Party Liability is included, with a deductible
amount of Euro 500 in case of accident involving the responsibility
of
the renter.The following insurance coverage (*) which is included in the
rental price indicated here below is applied to the
rented vehicle:

Damage Waiver
- 2.1 Liability
allowance for damages caused to the vehicle.
The Customer, upon return of the vehicle is responsible for
the damages caused to the vehicle that have not been
previously indicated in the appropriate form at car check
at the moment of the car withdrawal and signature of this
agreement. In case of damages to the rented vehicle, an
amount equal to the value of the effective damage and up
to the maximum allowance indicated on the cover of the
agreement will be charged.
- 2.2 Insurance
allowance for fire or total theft.
In case of fire or total theft that have to be communicated
immediately (in any case not after 6 hours) to ELITE
RENT A CAR ITALIA, the allowance indicated on the cover
of the agreement will be charged.
- 2.3 Liability
limitation clause for insurance allowance.
By signing the relevant clause for liability limitation,
as indicated on the cover of the agreement, the Customer
is
responsible for damages up to the reduced allowance
amount (LTDD), against payment of the indicated
supplementary price (LTDD2 Daily Insurance fee) or
(LTDD3 Daily Insurance fee).
However, the Customer must return the keys to the rental
agency within the rental period and in any case within
24 hours from the discovery of theft or fire. Damages
caused voluntarily or by misuse and/or disregard by
the
Customer are not included in the limitation liability
cases, neither damages to tapestry, to roof and subsequent
to
refuel with inappropriate fuel for the rented vehicle
or for damages repairs executed directly by the customer
without consent of ELITE RENT A CAR ITALIA, nor for
the use of the vehicle in presence of breakdown.

LTDD (Loss, Theft and Damage Deductible):
Loss, Theft and Damage
insurances are included in the cost of the rental with a deductible
amount as per brochure
under LTDD.
LTDDR (Loss, Theft and Damage Deductible Reduction):
The amount
of the deductible can be reduced by accepting additional daily
insurance fees as per brochure
under Daily DDR Fee (Damage Deductible Reduction) and Daily LTDR Fee (Loss
and Theft Deductible Reduction).
Elite reserves the right to refuse these deductible reductions.
- In case the renter
or the driver damages the vehicle intentionally or by gross
negligence , in case the vehicle is stolen intentionally,
by gross negligence
or by “abuse of trust” the renter or the driver will be held
liable up to the total value of the vehicle.
- Elite insurance
doesn’t
cover: damages caused by careless use of the car: wheels, hub-cubs, tyres,
radio K7, CD, GPS, antenna, upholstery,
external
mirrors, rims, convertible soft-top, gear-box, clutch etc.
- In case of
accident or mechanical problems, involving the responsibility
of the renter, he will be charged for a minimum of 5 days (10 days for
exceptional cars), up to the time required for the final repair (daily
rate 1-3 days).
Vehicle supply and return,
rental duration and resolution of agreement
The rental period starts on the date and time the vehicle is given
to the Customer and terminates on the date and
time the vehicle is returned to ELITE RENT A CAR ITALIA SRL. The
Customer recognizes that the vehicle is in
perfect operating conditions and without visible defects and undertakes
to return it to ELITE RENT A CAR ITALIA in
the same conditions and at the date indicated on the Car Rental
letter.
ELITE RENT A CAR ITALIA reserves the right to resolve the agreement
and get the vehicle back in any moment and
when it is used in violation of the “Utilization requirements” indicated
after these “General Terms and Conditions”.
The rented vehicle can be withdrawn and returned in one of the
ELITE RENT A CAR ITALIA offices or in another
location provided this is previously agreed ; withdrawal and return
must generally take place in the same office of
withdrawal, if not differently authorized by ELITE RENT A CAR ITALIA.
If the vehicle is returned in a different
location from the established one, the Customer will be charged
with all supplementary costs necessary to get the
vehicle back to the established location. The rental period is
calculated in days, that is to say 24 hours, and the
applied prices are calculated on 24 hour-units. The vehicle must
be returned at the established time; in case of a
delay exceeding 120 minutes, an extra day cost will be charged
to the Customer.
The Customer has the obligation, upon the vehicle return, to ask
the signature of a member of Elite rent a car's
staff on the Check-in report where the effective vehicle status
is reported as well as the fuel level. In absence of
this signature, the specifications listed by Elite rent a car Italia
will be tacitly and validly accepted.
The Customer has the obligation to return, together with the vehicle,
the keys, the documents, the Navigator Cd as
well as any other accessory that compose the vehicle's equipment.
The lack of return of the keys (also in case of loss) and/or car
documents and/or Cd Navigator will entail a penalty
amounting to € 5,000.00, plus VAT. In case of theft of the
vehicle, the lacking of return of keys will make the
Customer jointly and severally responsible of the theft of the
rented vehicle with the obligation to refund Elite rent
a car Italia Srl for the total car value according to the best
available quotations on Quattroruote plus a
supplementary penalty for the damage subsequent to the non utilization
of the vehicle previously determined in €
25,000.00, in absence of higher and supplementary damages. The
theft of the vehicle, with return of the keys, will
in any case entail a penalty of € 5,000.00.
Fines and penalties
The Customer and the driver are responsible for whatever infractions
to the Highway Code and are responsible for
the payment of all fines, penalties or sanctions issued towards
them (either by immediate claim or subsequent
communication also addressed to ELITE RENT A CAR ITALIA) for the
whole rental period. In case of lack of direct
payment of the above, the Customer expressly authorizes ELITE RENT
A CAR ITALIA to debit the credit card/s
mentioned in the cover of the agreement for all the amounts and
the legal and administrative charges necessary to
manage the fine claim. This amount is firstly evaluated to a minimum
amount of 20% of the amount claimed by
Authorities and not less than Euro 25,00, in absence of higher
and supplementary charges.
The Customer undertakes to transmit to ELITE RENT A CAR ITALIA,
within 48 hours, any fine that he receives from
public authorities. Failing this, he will be responsible for any
damage undergone by ELITE RENT A CAR ITALIA, also
indirectly, because of this missing immediate communication.
If the Authorities require the name of the Customer and/or of the
effective driver, ELITE RENT A CAR ITALIA is
bound to reveal it also without previous authorization of the Customer
and/or the driver.
Charges
The Customer will pay or refund ELITE RENT A CAR ITALIA the following
amounts upon request:
- a) Rental price, always paid in advance, according to the current
price list as indicated in the Car Rental Letter;
- b) Possible
charges for fuel recharge as indicated at point 4;
- c) Charges
related to the delayed payment of the amounts due. Invoices
issued by Elite rent a car Italia are
intended to be payable at sight and in case of delayed
payment the Customer and/or the person jointly and
severally liable will be compelled to pay the default
interests pursuant to Sect. 5, par. 1, of Law Decree
N. 231/02,
enforcing Directive 2000/35/CE; the Customer will also
be compelled to pay all legal, judicial and extra-judicial
charges in which ELITE RENT A CAR ITALIA incurred in
order to have the credit refunded;
- d) Any
fines, penalties, motorway charges, administrative expenses
(amounting to € 25,00 for each single
fine/claim) and judgement (according to the maximum
current lawyers’ remuneration
fees) or according to law and
deriving from the utilization of the vehicle during
the rental period, except for the case where they are
totally
and exclusively
chargeable to ELITE RENT A CAR ITALIA.
- e) Any
airport, railway, circulation charges or taxes.
- f) Supplementary
charges due if the vehicle is returned to ELITE RENT A CAR
ITALIA srl in a different location
from
the delivery, calculated according to the appropriate
price list (Leaving Service).
- g) All
the penalties provided by this Agreement (in particular the
penalty described in Point 5).
- h) All
the amounts – also in lucrum cessans and the vehicle
stop – that remain outstanding and not refunded by
the Insurance Company relevant to accidents caused
by the Customer.
- i) Relating
to the theft of the rented vehicle.
- j) Any
other amount not expressly indicated in this Conditions but
regulated by law or by
agreement

The Customer openly authorizes ELITE RENT
A CAR ITALIA to debit on the credit card/s
indicated
on the cover
of
this Agreement all the amounts, even they
have become due or collectible after the
return
of the rented
vehicle.
Waiver
Within the deadlines provided by Law, ELITE RENT A CAR ITALIA will
not be responsible for any damage that
affected the Customer or third parties deriving from the use of
the vehicle , for damages or inconveniences related
to the delay in withdraw or return or for any other cause out of
the control of ELITE RENT A CAR ITALIA (force
majeure).
Vehicle utilization conditions
The Customer undertakes to keep and use the vehicle with care and
attention and in particular he will not allow the
use of the vehicle in the following conditions:
a) to sub-rent;
b) to transport persons or objects with commercial purposes against
payment or in the cases forbidden by law;
c) to push or pull vehicles, caravans, trailers or any other objects;
d) for races, tests or competitions in or outside tracks;
e) to drive under the influence of drugs, alcoholic drinks, narcotics
or barbiturates or any other substance that can
affect the consciousness and the reaction capacity;
f) in violation of any custom or circulation regulation or any
other laws;
g) driven by another person that is not the Customer unless this
person has been indicated in the appropriate form
when filling the renting letter thus authorized by ELITE RENT A
CAR ITALIA;
h) Outside the European Community territory without prior written
authorization by ELITE RENT A CAR ITALIA; no
written authorization is requested for the following countries:
Switzerland, Liechtenstein, San Marino, Monaco,
Andorra, France, Germany, Austria.
Accidents
All accidents must be immediately reported Iin case of legitimate
obstacle not later than 1 hour after the accident)
and in any case in written not later than 6 hours after the accident
to ELITE RENT A CAR ITALIA. A report on the
Accident (Jointly Agreed Statement) must be filled at any time
it is requested and in any case always upon
vehicle's return. The Customer commits himself to obtain information
from witnessess and involved vehicles by
arranging the appropriate assessments by Competent Authorities.
The Customer also undertakes to cooperate with ELITE RENT A CAR
ITALIA, and/orm with any other owner of the
rented vehicle and/or with the involved insurance companies in
all legal assessments or procedures.
Joint and several obligation
The person who signs this Car Rental Letter in the name and behalf
of another physical or legal entity (companies,
Organizations, etc.) will be jointly and severally responsible
together with the person they represent for all
obligations assumed towards ELITE RENT A CAR ITALIA.
Release of responsibility
Within law limitations, the Customer releases any responsibility
to ELITE RENT A CAR ITALIA for whatever claim
related to the vehicle circulation or damages caused to the vehicle
or affecting the Customer or third parties during
the rental period, with the exception of events directly chargeable
to ELITE RENT A CAR ITALIA.
Vehicle Maintenance
The customer undertakes to use the vehicle appropriately and to
perform maintenance services required by the
vehicle's manufacturer . He will be responsible for whatever damage
caused to the vehicle. The Customer must
regularly check the levels of oil, water and brake fluid and in
any case, after 1000 km. Recovery, cleaning and
broken tyres costs are charged to the Customer. Oil, greasing and
possible small repairs related to ordinary use will be refunded only
against submission of regularly paid invoices (providing indication
of date, supplier
name, address, vehicle plate and km) entitled to Elite Rent a car
Italia S.r.l. after authorization and submission of
the replaced parts. In the event of a serious breakdown, the Customer
will address himself to the nearest rental
agency of Elite Rent a car Italia srl in order to require assistance
and/or the vehicle replacement.
Safekeeping Obligation
The Customer assumes the vehicle keeping and undertakes to always
keep it in a safe and protected place. He also
engages himself to always keep the keys of the vehicle.
Liability statement
The Customer and the driver declare to be aware of the fact that
in case of missing return of the vehicle according
to the conditions set forth in this agreement, in absence of any
valid contrary reason, (force majeure) they will be
charged with the crime of misappropriation or even of theft and
legal embezzlement.
Responsability
The vehicle manufacturer is always responsible for all manufacturing
defects; Elite Rent a car Italia Srl will take
care in order to rent the vehicle in the best possible conditions.
Nevertheless, Elite Rent a car Italia Srl can be in no
case deemed responsible for damages related to vehicle's breakdowns
occurred during the renting period.
Authorizations
The Customer - expressly and without any limitation - authorizes
Elite rent a car Italia, or any other appointed
entity, to exercise a remote supervision over the correct functioning
and utilization of the rented vehicle by
adopting satellite systems or similar devices to monitor the vehicle
alarms or movements out of the territory listed
in Art. 9h during the renting period.
Place of Jurisdiction
Any dispute arising from interpretation and/or execution of this
agreement will be settled by the competent Milan
Court , with the exclusion of the case as at Sect. 1469 bis of
the Civil Code.
