Required qualification

• Each driver must produce his/her driving licence (valid Category B driving license), having validity in the country where he/she will use the rented car; the driver must have held the driving license for a minimum period established by the law or local conditions; driving licenses in illegible scripts must be accompanied by an international driving license.
• The minimum age required to rent a car is 25 years. If the renter and/or driver is less than 25, he/she is aware that he/she will be applied different and higher deductibles pursuant to paragraph 2.1 below.
• The payment of the estimated rental fee and of any charges resulting from car damage or loss must be guaranteed at the time of rental.
• Car rental fees shall be paid by a major credit card, if accepted by the hirer, subject to authorization issued by the credit car issuer. A deposit amounting to the estimated rental fee and deductibles is required, pursuant to paragraph 2.2 below. The deposit may be paid by means of prior payment authorization by credit card.

Insurance coverage
The rented car is covered by the following insurance coverage, included in the rental fee stated in the back:

• Liability coverage for damage caused to third parties.
• Other risks: fire, total or partial theft, natural and socio-political events, car glass, assistance. 2.1 Deductibles for car damage
• When returning the car, the Customer is liable for any car damage not specified in the rental agreement when collecting the car and signing the rental agreement. In case of damage to the rented car, a fixed deductible will be charged, as specified in the front page of the agreement.
• 2.2 Deductibles in case of fire or total theft In case of fire or total theft, to be communicated immediately (and anyway within 6 hours) to PRIME Srl;, a fixed deductible corresponding to 10% of the stated value will be charged, as specified in the front page of the agreement.
• 2.3 Liability limiting clause
  By signing a separate liability limiting clause, in the front page, the Customer (provided he/she is more than 25 years old) is exempted from paying the deductibles under paragraphs 2.1 and 2.2 above) upon payment of a surcharge indicated in such clause. The Customer shall anyway return the car keys to the hirer by the date established to return the vehicle, and anyway within 24 hours of the time when the fire or theft has been discovered. The clause does not cover damages caused voluntarily or due to the Customer's carelessness and/or negligence, damages to the car upholstery and roof, damages caused by the use of fuel other than the right fuel for the type of car rented and repairs performed directly by the Customer without PRIME Srl;'s approval, or damage caused by the use of the vehicle despite a breakdown.

Kilometres
Rates include 250 km a day, beyond which a rate per kilometre must be agreed and stated in the “Rental letter ”.

Vehicles, fuel, maintenance
If a vehicle is not available at the location or was previously booked by another customer, it cannot be rented. Rates do not include fuel. Vehicles are normally provided with a full tank. If the tank is not full when the vehicle is returned, the missing fuel will be charged to the Customer, in addition to a service fee amounting to €30 per quarter of tank to be filled. Ordinary maintenance, oil and lubricant are included in the rental fee. Road assistance costs, expressly approved by "PRIME Srl;"only if it can be proven that assistance numbers indicated in the rental agreement have been called, will be refunded upon presentation of the original invoice.

Returning of vehicle and rental period
The Customer acknowledges that the vehicle is in good operating conditions, with no evident defects and undertakes to return it toPRIME Srl;. in the same conditions and at the date indicated in the Rental letter. PRIME Srl; reserves the right to terminate the agreement and regain possession of the vehicle at any time and if the vehicle is used in violation of the “Use conditions” specified below. The rented vehicle may be picked up and returned at one of PRIME Srl;’s locations or at any other location previously agreed. Normally vehicles are picked up and returned at the same location, unless differently authorized by PRIME Srl; which, in case of pick up and/or return at a place other than the place agreed, may ask for a refund. The rental period is calculated on a 24-hour day basis and the rate is calculated on 24-hour periods. The vehicle must be returned by the agreed time; in case of delay by more than 120 minutes an additional day will be charged. According to the rental formula called “week end”, the car is picked up on Friday afternoon and returned by 10.00 a.m. Monday, unless a different time frame is agreed. Failure to return keys, registration card and GPS CD entails extension of the rental period until they are returned or a written loss or theft report is submitted. Loss or theft of each of the above-mentioned objects entails a penalty of €500

Fines and penalties
The Customer and driver are liable for any breach of Road Code provisions and must pay fines or penalties (notified immediately or at a later time, including those notified to PRIME Srl; relating to the rental period. If the above-mentioned fines or penalties are not paid directly, the Customer authorizes PRIME Srl; to charge the relating amounts to the credit card(s) indicated in the front page. The Customer undertakes to send to PRIME Srl;, within 48 hours, any report notified by public authorities. Otherwise he/she will be responsible for any damage suffered by PRIME Srl;, even indirectly, due to failure to communicate it promptly. If so requested by the police, PRIME Srl; must provide the name of the driver or drivers, to whom the fine will be notified for payment.

Charges
The Customer, upon request, must pay or refund the following amounts to PRIME Srl;:

• 1. Rental fee, always paid in advance, in accordance to the price list in force or indicated in the Rental letter;
• 2. Any fuel service charges pursuant to paragraph 4 above;
• 3. Costs deriving from late payment of amounts due. The Customer shall pay late payment interest at current legal rate plus 3%; the Customer shall also pay all legal costs, including court and out of court expenses, incurred by PRIME Srl; to collect receivables;
• 4. Fines, penalties, administrative expenses and legal costs deriving from the use of the vehicle during the renApplicable tax in the rental period;tal period, unless they are imputable to PRIME Srl;
• 5. All outstanding amounts not reimbursed by the insurance company relating to accidents caused by the Customer or relating to the theft of the rented car;
• 6. All amounts provided for in this agreement, although not specified here.
  The Customer expressly authorises PRIME Srl; to charge all amounts to the credit card(s) indicated in the front page, including those that have become collectable after the vehicle has been returned. In no case will the customer who has behaved illegally be waived from liability towards any authorities.

Exemption from liability
Within the limits set forth by the law, PRIME Srl; cannot be held liable for damages suffered by the Customer or third party deriving from the use of the vehicle; for damage caused by delays in returning the vehicle; for any other cause beyond PRIME Srl;'s control.

Vehicle use conditions
The Customer must keep and use the vehicle diligently, and in particular he/she shall not allow the vehicle to be used in the following cases:

• 1. Sub-rental
• 2. To transport people or goods for commercial purposes, upon payment of whatever amount or in the cases forbidden by the law;
• 3. To push or tow vehicles, caravans, trailers or anything else;
• 4. For races or tests;
• 5. Driving by Customer or driver under the influence of alcohol, drugs, narcotics or barbiturics or of any other substance that may affect consciousness, or ability to react rapidly;
• 6. In violation of any customs, circulation or other provisions;
• 7. Driving by a person other than the Customer unless the person has been mentioned in the suitable space when filling in the Rental letter and therefore authorised byPRIME Srl;
• 8. Outside the European Community borders without prior written consent by PRIME Srl;; no written authorisation is required for the following countries: Switzerland, Liechtenstein, San Marino, Monaco, Andorra.

Accidents
All accidents must be communicated to PRIME Srl; immediately and anyway within six hours. An accident report (C.I.D. form –agreed accident report) must be drawn up at any time, if requested, and anyway when the vehicle is returned. The Customer undertakes to obtain data relating to witnesses and vehicles involved. The Customer also undertakes to cooperate with PRIME Srl; and its clients with respect to any investigation or legal proceeding.

Joint and several obligation
The person who signs this Rental letter on behalf of other people and/or companies shall be liable jointly and severally with the person or entity represented, with respect to the obligations taken with PRIME Srl;

Hold harmless clause
Within the limits set forth by the law, the Customer holds PRIME Srl; harmless with respect to any claims associated to the circulation of the vehicle and to damages to the vehicle, the Customer or third parties, unless the cause can be imputed to PRIME Srl; only.

Competent Court
For any controversy the only competent court is the Court of Rome.
