Terms and Conditions
Definitions and general concepts
By entrusting the vehicle, FORONEDAYORMORE committed
to you and you agree to return under the contractual terms
and conditions you are set out below, subject to force majeure
as defined in section 1148 of the Civil Code. Any deviation
from these conditions should be subject to a prior written
consent of Lessor.
The different concepts that refer to these conditions shall be interpreted
in the light of Recommendation 96-02 of the Commission on unfair terms and
the law applicable to the SSA (Section 1713 et seq). The rental agreement is
entered into a personal basis and can not be assigned.
" You", "Lessee" means (the) driver (s) and (the) pay (s)
listed on the lease and signed it that the quality of tenant. ? "We", " the
Host "means the company FORONEDAYORMORE, whose name appears on the lease.
? FOONEDAYORMORE is a joint stock company with capital of 50,000 euros, whose
registered office is located 22, rue Washington - Paris (75008), registered Trade
and Companies of Paris under number 522 804 640. ? "Vehicle" means
a passenger car that we rent for the agreed term of the lease. ? "Damage" is
regarded as damage, any damage occurring to the Vehicle ? " Flight "is
assimilated to theft: vandalism, theft of accessories and attempted theft. ?" Territory "means
the countries in which the rental vehicle traffic is allowed, namely: Andorra,
Austria, Belgium, Denmark (excluding islands and enclaves Ceuta and Melilla),
Finland, France, Greece, Ireland, Italy, Luxembourg, Monaco, Netherlands, Portugal,
United Kingdom, Sweden, Switzerland. ? operation of the vehicle is strictly prohibited
in all other countries, areas or territories and especially in the islands (including
Corsica, but location made at the start of this island), not listed above.
Eligibility
for rent
You
must provide us with documents, all information necessary for the
establishment of your lease, including: your identity, address,
category and date of issuance of your driver's license, a way to
pay your rent as indicated. All drivers must be at least 25 years
and holds a driver's license, valid for at least 24 months and
for the category of vehicle rented.
STATE VEHICLE
A state
description of the vehicle is attached to your contract. You agree
to write down, before you leave any apparent defect that is not
there. Otherwise, we are deemed to have issued a vehicle conforming
to the description. Unfortunately we can not ignore complaints
about the apparent damage that have not been reported at the time
of departure. You must return the vehicle in the condition you
received it. ? All costs of rehabilitation, resulting from a fault
of the tenant or absence of fault of an identified third party,
will overload the cost of renting subject to the provisions of
the "optional contractual guarantees."
USE
OF VEHICLE
You should never circulate the vehicle other than the Territory (see definition,
Section 1). ? accordance with the principle that penalties, you are responsible
for crimes committed during the rental period. Thus, you are informed that
your details may be provided to competent authorities, at their request and,
if necessary, you will be liable for costs of processing record up to 50 (fifty)
euros. The Tenant expressly authorizes the Lessor to use its means of payment,
including credit card, to get paid the corresponding amount. You agree to use
the vehicle in "good father" and, without being under the influence,
or Ethyl narcotic or any substance likely to affect the conduct in accordance
with the Highway Code and use it for its intended purpose which, for a particular
vehicle is mainly the carriage of people for free.
ATTENTION: In case of failure
to appreciate the size of the vehicle, high impact body and under body
are not covered under warranty damage except to prove the case of force
majeure.
You do not have to use the rented vehicle including: - to be rented; - to transport
persons for remuneration; - to transport a number of people than that shown
on the registration of the vehicle; - to participate in rallies, competitions
or trials, regardless of the place; - to give driving lessons; - to push or
tow another vehicle; - on roads not passable, or the surface or the state of
maintenance has risks to the tires or bodies under the vehicle; - to commit
an intentional crime.The goods and baggage carried in the vehicle, including
packaging or dunnage, must not damage the vehicle or run abnormal risk to its
occupants. When you park the vehicle, even for a short stop, you agree to close
the vehicle key and you use the alarm and / or theft which the vehicle is equipped.
You should never leave the vehicle unoccupied with the keys in the ignition.
The lack of restitution of the keys to vehicle will result in forfeiture of
the guarantee flight. In case of damage or theft, you must pass to Host the
joint report of accident within 5 (five) working days or receipt of theft report
issued by the authorities, under 2 (two) working days, and the keys and vehicle
documents.
ATTENTION: Article 3-2 states
the minimum requirements to be observed during the period in which you have
custody of the vehicle.
PICK
UP AND DROP OFF
FORONEDAYORMORE operates through its Agency, located at 10, Place Vendôme
- 75001 Paris, in the very heart of the most exclusive of Parisian districts.
Pick-up and drop-off can be arranged from Monday to Sunday, within operating
hours from 8 am to 8 pm.
Time of pick up and drop off has to be indicated by you at the moment of making
the reservation.
A member of staff of FORONEDAYORMORE will be dedicated to your personal pick
up and drop off.
FORONEDAYORMORE
will ask your mobile phone number at the moment of the reservation;
this phone number has to be obligatorily operational at the moment
of pick up and drop off. In addition, the person who made the
reservation has to be obligatorily present at the moment of the
pick up, with the following documents: identification document,
a valid driving license and the same credit card as used for
the payment of the booking. These documents will be copied by
our staff member and given back to you immediately.
For the pick
up the FORONEDAYORMORE staff member will be waiting for you with
a maximum tolerance of 45 min. after that your reservation will
no longer be valid due to no-show. In this case 100 percent of
the estimated rental charge already paid will be kept by FORONEDAYORMORE
and not be refunded.
At
the pick up you will receive the following documents:
1. Two copies of your contract. Both copies have to be signed by you and one
given back to the member of staff.
2. Two copies of the car record document certifying kilometres and any agreed
defects of the MINI. Both copies have to be signed by you and one given back
to the member of staff. This last document will be used at the moment of the
drop off to verify the condition of the car.
For the drop
off you will be waited for up to 45 min. maximum. After this
period you will have to arrange a new drop off time and pay a
supplementary day.
NO
SMOKING
FORONEDAYORMORE wants your MINI to be perfect; clean and pays great attention
that our friends can fully enjoy the drive.
Therefore we kindly ask you not to smoke in your MINI. In the case of no respect
of this recommendation, FORONEDAYORMORE will charge you for a penalty of €3000,
necessary to substitute interiors.
EXTRA
KILOMETERS, REFUELLING, FUEL PURCHASE OPTION
Full Tank - EUR 90.00
Airport Delivery - EUR 90.00
For each extra kilometer FORONEDAYORMORE will charge you € 0.70.
Your
MINI has been supplied to you with a full tank of fuel: you can
decide to give the car back without refuelling: in this case an
extra cost of € 15 will be charged, plus € 2 for each
missing litre.
However,
if you take the Fuel Purchase Option and purchase a full tank of
fuel at the start of the rental, there will be no refuelling charge.

card will be debt for the difference.
MAINTENANCE
/ MECHANICAL PROBLEM
During
your tenancy and the number of kilometers traveled, you have to
do the usual checks (engine oil level in excess of 1000 km, tire
pressure, etc.). In accordance with a use of " good father. " As
such, the Lessee will remain vigilant to any signal emitted by
the warning lights appear on the dashboard of the vehicle, if any,
and take all necessary measures, if any, such as shutting down
emergency. The vehicle is provided with tires whose condition and
number are consistent with traffic laws. In case of damage to one
of them for any reason other than normal wear and tear, latent
defect or force majeure, you agree to replace it immediately at
your expense by a tire of the same size, same type , same brand,

than a technical failure, the tenant must pay the mileage allowance
calculated on the basis of 500 miles per rental day. Any processing
or mechanical intervention on the vehicle is prohibited without
prior approval of Lessor.
TERMS
AND LENGHT OF RENTAL
The
Tenant agrees to return the vehicle to the lessor at the date the
lease or face legal action civil and criminal. The rental period
is calculated for every 24 (twenty four) hours, no smaller, since
the time of release of the vehicle, but however you have a tolerance

These documents
will be photocopied and returned immediately to the tenant. ?

a maximum
of 45 minutes from the time specified when booking, after this
period, the reservation will be canceled due to no show and an
amount equal to 100% of the total cost of the reservation will
be charged on the credit card of the tenant. A copy of the contract
will be given to the tenant and another to be signed by the same
and returned to the FORONEDAYORMORE agent. A statement on the

the tenant to
keep a copy. This document must be presented at time of the return
to verify any damage on the car. ? When returning the car, the
renter will be expected to a maximum of 45 minutes compared to
the time indicated in booking and after this period, the tenant
must pay an additional day. It will also have a duty to indicate
the time of the return of the car the next day in accordance
with the areas, times and conditions indicated previously in

LEASE
The
lease ends with the return of the vehicle, its keys and the rental
papers. ? In the event that the vehicle is returned without its
keys, they will be charged to the tenant and, where appropriate,
repatriation of the vehicle. The Lessor shall in no way be held
liable for any property that would have been forgotten in the vehicle
at the end of the lease.
ATTENTION: Only taking possession
of the vehicle, documents and keys to the rental agent, to FORONEDAYORMORE
opening hours, can terminate the lease. ? Reminder: You are liable until
the end of the lease.
Exceptions: in case of confiscation or sealing of the vehicle, the
lease may be terminated automatically when the rental will be informed by the
authorities or by the Tenant. Any use of the vehicle that would prejudice the
Lessor allow it to automatically terminate the contract. In case of theft,
the lease shall end upon delivery to Lessor of complaint made by the Tenant
from the competent authorities. In case of accident, the lease shall end upon
delivery to Lessor of an accident report completed by the Tenant and any third
parties.
PAYMENT
The
renter must always pay in advance at the time of booking. Payment
can be made only with the following credit cards: VISA, MASTERCARD,
AMERICAN EXPRESS, DINERS ? The amount specified in the receipt,
including VAT, rental fees and extras. A deposit of € 2,000
will be blocked at the time of booking. FORONEDAYORMORE not keep
any record of your bank.
APPLICABLE RATE
Rates
for rental, with additional services, warranties and optional insurance
are current at time of booking and correspond to the conditions
you set. Any modification of these conditions result in the application
of another rate corresponding to the new conditions. The vehicle
is provided with a full tank. You must return it in the same condition.
Otherwise, the cost of Fuel Service (€ 15) and the number
of gallons of missing fuel will be charged (€ 2 per liter)
? The cost per additional kilometer is € 0.7
DEPOSIT
The amount of the deposit is intended to cover the damages suffered by the
Lessor resulting from damage or theft of the vehicle. ? The amount is stated
at the outset of the rental on your contract. The security deposit shall
accrue to the Lessor for any damage caused to the Tenant or absence of
fault of an identified third party and in case of vehicle theft (except
pursuant to contractual guarantees outlined below) and this in height of
the injury. In the absence of damage and / or theft, the amount of the
deposit actually paid will be refunded at the end of the lease.
CANCELLATION AND EXTENSION OF RENTAL
- In
case of cancellation of booking the last 48 hours preceding
the scheduled
date, an amount equivalent to 70% of the
total reservation will be charged.
- In case
of cancellation of booking within 48 hours preceding the scheduled
date or in case of no show, an amount equal to 100% of
the total reservation will be charged on the credit card.
Liability
for damage to the vehicle or theft
You are responsible
for the vehicle that you care. In case of accident, with or without identified
third party, you must complete an accident report car and put it back in a
period not exceeding 5 (five) business days FORONEDAYORMORE. If not, and if
the rental was challenged by an opposing insurance company, then you would
be liable to pay the processing fee issue amounting to 200 euros TTC. In any
case, you will be liable for compulsory processing fee amounting to file 50
(fifty) euros, payable in the event that your responsibility is not engaged.
These fees
are in addition to any amount charged under the non-waivable,
even beyond the limit of the latter If the tenant damages the
driver or the vehicle
by intent or gross negligence, if there is loss of the vehicle with gross
negligence , breach of trust or by intention, the tenant or the
driver is responsible
up to the value of the vehicle. FORONEDAYORMORE insurance does not cover:
windshield, tires, wheels, hood, harness, antenna, mirrors, inside
the vehicle, radio,
CD, GPS, or mechanical damage resulting from misuse of the vehicle gearbox,
clutch, brakes etc.. If fault accident or mechanical damage caused by
misuse of the lessee or driver, he will be charged an immobilization
period of at
least 5 days until the total duration of the repair (day rate).
7-Our contractual guarantees CAUTION: DO
ALL THESE PROTECTIONS exercised in the territory (see list of
countries 1-definitions) DURING THE TERM OF RENTAL AGREEMENT
AND SUBJECT TO COMPLIANCE WITH THE PROVISIONS OF ARTICLES .
WARRANTY DAMAGE AND / OR THEFT
The
damage e theft of the vehicle are included in the price of the
rental with a deductible of € 2,000. ? ATTENTION: ? These
warranties do not cover damage "high case" or "in
cash" or lapses of security mentioned herein Article 7 ..
2 which remain fully applicable. also excludes any warranty damage
and theft of goods transported.
You may be charged for each claim the amount of the non-waivable, which is
indicated on the contract at the start of your rental. ? If the amount of damage
actually suffered by the lessor is less than this amount, only the lower are

from third parties responsible for this amount will be fully refunded.
LOSS
GUARANTEE
Drivers not identified at the lease, which Tenant is responsible, are not entitled
to the benefit of guaranteed damage or theft of the vehicle. Disrespect of
any of the obligations specifically set forth in sections 2, 3-2, 4-2 of these
Terms will result in forfeiture of contractual guarantees subscribed. Or the
Tenants will be responsible for the entire loss in terms of common law liability.
Insurance
All our vehicles are covered by a police "Liability vis-à-vis third
parties" in accordance with the regulations, has taken out this insurance

119111271. In case of breakdown or accident, towing charges and parking are
the responsibility of the tenant.
Jurisdiction
clause
Any
dispute between merchant born of this contract and that could not
lead to an amicable agreement shall, to the extent permitted by
